Problem

According to data received from government agencies, the share of counterfeit alcohol reached 70% of the total market. There was a significant drop in sales in Russia, Ukraine, Kazakhstan, Georgia, and Kyrgyzstan. Counterfeit alcohol products are particularly dangerous since they put consumers’ health and lives at risk.

Solution

The TKM сompany became the representative of the right holder on the territories of the above-mentioned countries. The work was carried out in many directions and consisted of online monitoring, collaborating with government agencies, checking offline retail sites, and seizure of production sites and warehouses. The trademark was registered in the Customs Register of Intellectual Property Objects (Russian abbreviation — TROIS). In conjunction with customs authorities, import of bottles, bottle caps, and labels for counterfeit products was stopped at the border. Online stores’ pages that had been distributing counterfeits were blocked.

Result

The share of counterfeit alcohol has decreased, while the sales have increased. The damages have been recovered. Over the entire period of cooperation, more than 435 000 litres of counterfeit alcohol have been seized and destroyed. Over 300 trials have been held.

A well-known French company that owns several brands of luxury cosmetics, perfumes, and accessories.

Problem

Due to the distribution of counterfeit products, the company faced a significant drop in sales in Russia, Ukraine, and Kazakhstan. Counterfeiting of cosmetics and perfumes is dangerous since a consumer may not realize that they have purchased a fake. Fakes can be sold under the guise of the original products and at the original price. That causes a double decrease in sales: due to the substitution of original products for counterfeit ones on the market and the subsequent loss of the brand’s reputation.

Solution

The TKM company became the representative of the right holder. The trademark was registered in the Customs Register of Intellectual Property Objects. Thanks to cooperation with the customs authorities, import of counterfeit products was stopped. In conjunction with law enforcement agencies, the TKM operative department carried out a number of operations for each detected counterfeit case: test purchases, independent examinations, and seizures and destruction of counterfeit products. Online stores, both the ones with private domains and the ones that use social networking platforms, were detected and blocked.

Result

The sales have increased and the brand’s reputation has been protected. Over the entire period of cooperation, 101 948 units of counterfeit products have been identified and destroyed in Russia, 78 455 in Ukraine, 7 379 in Kazakhstan. More than 250 criminal and administrative cases have been initiated.

Since fakes of the brand’s apparel, footwear, and bags are in demand, the right holder suffered significant damages and the brand’s reputation was undermined.
